Notices for copying and communicating works in reliance on the University's Statutory Licenses
Under the Part VA Statutory Licensing Scheme, the University may copy and communicate broadcasts (from television, cable, satellite, radio and podcasts) for the educational purposes of the University of South Australia.
When to use the Notice If you are making an analog copy (audio or video tape), it MUST be marked (either on the tape cassette itself or on the jacket/sleeve in which the cassette is kept) with the Part VA label. Copies MUST only be distributed to staff and students of the University.
If you are making a digital copy (i.e. on CD-ROM), there is no statutory requirement to label it, although this is recommended.
Each copy of a digital recording MUST display the Part VA Warning Notice either prior to or at the same time that the broadcast is being communicated to the screen.
Under the Part VB Statutory Licensing Scheme, the University may copy and communicate a reasonable portion of a print or electronic work for the educational purposes of the University of South Australia.
When to use the Notice The Part VB Warning Notice MUST be displayed if you are reproducing or communicating any text, images, or notated music in electronic form. The Notice MUST be prominently displayed on each copy made in reliance on the Part VB Licence and MUST appear either prior to or at the same time that the material is communicated to the screen.
For linear files such as PowerPoint presentations, which will only be shown in class, it is acceptable to make the Part VB Notice the first slide of the PowerPoint.
If you subsequently make the PowerPoint available on CD-ROM or online to your students, a copy of the Notice needs to be displayed on the same page as each work copied in reliance on Part VB. This will ensure that the user sees the Notice regardless of where they might open the file.
DO NOT use the Part VB Notice if the works you are copying or communicating are
- covered by contractual agreement, such as Library databases, CD-ROMs, e-journals and e-books
- copied with permission

Definitions
You are making an Electronic copy when you copy from
- Hard copy to electronic e.g. print to PDF or CD-ROM, slide to PDF, photograph to jpg, transparency to PPT.
- Electronic to electronic e.g. hard drive to online, CD-ROM to online, one file type to another e.g. Word to PDF.
- Electronic to hard copy, e.g. printing from an electronic journal, database or website
You are Communicating when you
- Make material available on-line or electronically transmit (e.g. via email attachment or fax to students)
All online communications (including PowerPoint presentations placed online) MUST be registered through the Digital Resource Service and access restricted to staff and students of the University of South Australia.
